Effective January 1, 2015
This Policy is effective for all current and new Users on their first access of the Website after the Effective Date. Certain consultants, businesses and other entities (“WorkerFIT Clients”) have written “Consultant Agreements” (also known as “Client Agreements”) with WorkerFIT which may also govern access/use of the Content by any User whose access/use is granted by or through the WorkerFIT Clients, whether as their employees, consultants, agents or otherwise (the “Consultant Authorized Users”). Conflicts between this Policy and any applicable Consultant or Client Agreement will be controlled by this Policy unless the Consultant or Client Agreement expressly provides more privacy.
This Policy does not apply to, and WorkerFIT has no responsibility for, the privacy practices of any other websites referenced or linked in, to or from the Website.
What Personally Identifiable Information Is Collected
Users may browse the public portions of the Website without disclosing their identity or revealing any personal information. At certain public pages, the User may voluntarily enter personal information, for instance to participate in a survey. Once any User discloses personal information on one of the public pages, anonymity is gone and the User consents to the transfer and storage of that information on WorkerFIT’ servers located in the United States and the use and disclosure of that information as described below.
Users using the Website under a Consultant or Client Agreement may collect and enter personal information on the Website that belongs to others, including the Consultants’ or Client’s employees, prospective employees or agents. WorkerFIT assumes all appropriate individuals have consented, if required by law or policy, to that information being collected, stored, used and disclosed by WorkerFIT according to this Policy unless otherwise restricted (and then as provided) by the Consultant or Client Agreement.
WorkerFIT may collect, store, use and disclose the following personal information from its public and Client only pages:
Email address, physical contact information, and (depending on the service used) sometimes financial information, such as credit card or bank account numbers, but only for the purpose the information for which it was provided.
Other information from interaction with the Website, including computer and connection information, statistics on page views, traffic to and from other websites through the Website, IP address and standard web log information.
Additional information for identity and address authentication.
WorkerFIT may use your personally identifiable information, in conjunction with information available from other sources, to market new services to you that we think will be of interest to you, but we will not disclose your customer identifiable information to third parties who want to market products to you. In addition, we may collect information regarding the website URL that referred you to our site, your IP address, and information about your page view habits on our site. We may use your IP address to help diagnose problems with our site or web server, and for the general administration of our website. Your IP address is also used to help prevent you from creating duplicate accounts. The only information that we automatically collect is that related to the use of our web site.
How the Information You Provide Is Used
WorkerFIT collects and retains personal information primarily to provide a User with services appropriate to the User’s specific situation and, in the case of a Client Authorized User, to provide the WorkerFIT Client, consistent with legal restrictions, with the information required by the Client Agreement). In addition, WorkerFIT may retain and use non-personally identifiable information (i.e. information as to which a User’s identity is not tracked) to develop new products and services, make the Website more useful, for example, using site analytics to improve site layout and Content, and perform studies, reviews and research.
Unless otherwise restricted by the Client Agreement, WorkerFIT may disclose personal information:
In the case of a Client Authorized User, to the WorkerFIT Client as required by the Client Agreement.
In the case of non-personally identifiable information, to the public (typically in the form of summaries/compilations as part of studies, white papers and reports).
To third parties the User explicitly requests receive personal information or about whom the User is notified and consents.
To law enforcement or other governmental officials, in response to a verified request relating to a criminal investigation or alleged illegal activity, or otherwise to meet legal requirements.
To service providers under contract to assist with WorkerFIT’s business operations provided such providers are contractually required to follow this Policy.
Any business entity WorkerFIT has agreed to (or does) merge with or be acquired by (in which case WorkerFIT will contractually require that entity follow this Policy with respect to personal information and give the User notice before any use contrary to this Policy).
Each WorkerFIT disclosure will comply with all applicable laws.
WorkerFIT uses "cookies" (small files placed on a User's computer hard drives when accessing the Website). Cookies help WorkerFIT to make a User’s Website visit more efficient and productive.

WorkerFIT has implemented technology and security features and policy guidelines to safeguard the privacy of your customer identifiable information from unauthorized access or improper use. We use encryption technology when collecting and transferring sensitive data, and will continue to enhance our security procedures as new technology becomes available. We make available a secure page for entering sensitive information, protected by industry-standard SSL encryption technology. This technology encrypts your information prior to transmitting it over the Internet. We maintain personally identifiable information and protected health information (hereinafter “confidential information”) you provide us in a secure database stored on servers located in the United States.

This Policy and the use of this Site are governed by Ohio law. Any claim related to the Site or this Policy shall be brought in a federal or state court in Ohio within one year after the claim arises.
